McCormick Distilling Company – 360 Vodka Kansas City Chiefs AFC Championship Game Sweepstakes

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. PARTICIPATION CONSTITUTES PARTICIPANT’S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES.

I. ELIGIBILITY:
The McCormick Distilling Company “360 Vodka Kansas City Chiefs AFC Championship Game Sweepstakes” (the “Sweepstakes”) is open only to legal residents of the states of Missouri, Kansas, Nebraska, or Iowa who are twenty-one (21) years of age or older at the time of entry. By entering this Sweepstakes, you are affirming that you meet these eligibility requirements. Employees of McCormick Distilling Company (“Sponsor”), Sponsor’s beverage alcohol licensees, and each of their respective parents, affiliates, subsidiaries, suppliers, distributors, retailers, advertising and promotion agencies, prize suppliers or any other persons or entities directly associated with this Sweepstakes (collectively, the “Sweepstakes Entities”), and each of their immediate family members and/or members living in the same household as such persons, are not eligible to enter this Sweepstakes or win a prize. For purposes of this Sweepstakes, immediate family members are defined as spouse, domestic partner, parents, legal guardians, in-laws, grandparents, siblings, children, and grandchildren.

II. SWEEPSTAKES ENTRY PERIOD:
Begins at 12:00 pm Central Time on Tuesday, January 14, 2020, and ends at 2:00 pm Central Time on Friday, January 17, 2020 (the “Entry Period”).

III. HOW TO ENTER THE SWEEPSTAKES:
Entrants may earn up to three total entries:

  1. One entry is available to any person who meets the age and domicile eligibility requirements specified above and who:
    1. Likes the 360 Vodka Sweepstakes post on Facebook, and
    2. Tags a friend
  2. One entry is available to any person who meets the age and domicile eligibility requirements specified above and who:
    1. Likes the 360 Vodka Sweepstakes post on Instagram, and
    2. Tags a friend
  3. One additional entry is available to any person who: 
    1. Posts a photograph of themselves on either Facebook or Instagram, 
    2. Wearing Kansas City Chiefs clothing or gear and holding a 360 Vodka Kansas City Chiefs commemorative bottle, and
    3. Tags @360Vodka.

All requirements must be met for an entry to be deemed valid. No purchase is required. Entrants must be at least 21 years of age to be eligible, and age verification will be required prior to Prize being awarded.

IV. WINNER SELECTION AND NOTIFICATION:
The potential winner will be selected by drawing using a random name generator on FanPageKarma.com on January 17, 2020, from all eligible entries received in accordance with these Official Rules. Sponsor will have complete discretion over interpretation of the Official Rules, of administration of the Sweepstakes, and of selection of the winner. Decisions of the Sponsor as to the selection of the winner will be final. The potential winner will be notified on January 17, 2020, via the Facebook or Instagram account that was used for entry. Notification is deemed to have occurred immediately upon sending of a message to the social media account used for entry, and sweepstakes eligibility will be required immediately, including age verification and proof of state of residence. Once the winner’s eligibility has been confirmed, the winner will also be announced on the 360 Vodka Facebook and Instagram pages. 

V. PRIZE:
One Prize Winner will be awarded two tickets to the AFC Championship game at Arrowhead Stadium scheduled for Sunday, January 19, 2020 at 2:05 p.m. A parking pass will also be awarded as well as a 360 Vodka Kansas City Chiefs Swag Package that will include the following: Two 360 Vodka Kansas City Chiefs T-Shirts, Two 360 Vodka Kansas City Chiefs Hats, and Two 360 Vodka Kansas City Chiefs Scarfs. Transportation to and from Arrowhead Stadium is not included. Approximate Retail Value (“ARV”) of this Prize is $1,000. Odds of winning the Prize will depend on the total number of eligible entries received at the time of the Prize drawing.

VI. TERMS AND CONDITIONS:
The Prize package is not exchangeable or redeemable for cash. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute any prize package with another prize of equal or greater value in the event that the prize (or any component thereof) is not available. The winner is required to comply with any and all applicable federal, state and local laws, rules and regulations. The stated “ARV” of the prizes is based on available information provided to Sponsor at the time these Official Rules were drafted (and any difference in ARV at the time of awarding will not be awarded) and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The Winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prize they receive. The Sponsor Entities are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify the potential winners. All properly claimed prizes will be awarded. The Sponsor and its agents are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any prize awarded in this Sweepstakes. The Winner’s acceptance of the prize constitutes permission (except where prohibited) for the Sponsor to use the winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) for any and all public relations, advertising and/or promotional purposes as determined by Sponsor, in all forms of media and by all manners (now and hereafter known), in perpetuity, without notice, consent, review or approval or further compensation.

VII. OPT-IN:
By participating, you consent for the Sponsor to obtain, use, and transfer your name, address and other information for the purpose of administering this Sweepstakes. You are authorizing the Sponsor to send you emails to the address entered on the entry form, about its products, services and other news. You may opt out of receiving future emails from Sponsor by clicking on the link contained in the initial email. You will remain eligible for this Promotion whether or not you opt out of receiving promotional emails from Sponsor.

VIII. USE OF PERSONAL INFORMATION:
The information that you provide in connection with the Sweepstakes entry process may be used by Sponsor for Sponsor’s internal purposes in connection with the operation of the Sweepstakes such as to communicate with entrant in relation to this Sweepstakes or on a Sweepstakes winners list and such information will only be used to send entrants information about Sponsor’s products and other offers if you consent to use in such manner.  For more information about Sponsor’s use of personal information, see Sponsor’s privacy policy by clicking on the Privacy Policy link indicated on Sponsor’s website. Any requested opt-in consent is not required to enter the Sweepstakes and will not increase your chances of winning.  All entries become the property of Sponsor upon receipt and will not be acknowledged or returned. 

IX. SUSPENSION / MODIFICATION / TERMINATION:
In the event Sponsor is prevented from continuing with the Sweepstakes by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Sweepstakes by any party, or any federal state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence) Sponsor shall have the right to modify, suspend or terminate the Sweepstakes.  Sponsor additionally reserves the right, in its sole and absolute discretion: (1) to modify, suspend or terminate the Sweepstakes should causes beyond Sponsor’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Sweepstakes; or (2) to disqualify any entrant found to be, or suspected of: (a) tampering with the entry process or the operation of the Sweepstakes; (b) acting in violation of these Official Rules; or (c) acting in an unsportsmanlike manner.

X. WAIVERS, DISCLAIMERS AND RELEASES:
By participating in the Sweepstakes, Participants agree to release, discharge and hold harmless the Sweepstakes Entities from and against any and all claims, liability, costs, losses, damages or injuries of any kind arising out of or related to entrants’ participation in the Sweepstakes and/or related to any prize.

XI. GOVERNING LAW/LIMITATIONS OF LIABILITY:
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Sweepstakes Entities in connection with the Sweepstakes will be governed by and construed in accordance with the internal laws of the State of Missouri, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.

360 Vodka takes the protection and proper use of your personal information seriously. We respect your privacy, and take great care to safeguard information in our possession. Your preferences for use of your information are our highest priority.

360 Vodka does not share customer information (including e-mail addresses) unless it is necessary to provide you with 360 Vodka products or services, or we are legally required to do so.

We restrict internal access to your information to those individuals who need it to provide you with services. Any third-party companies we must use to provide you with services are required to keep your information secure and confidential.

California Supply Chains Act

McCormick Distilling Co., Inc. is a distilled spirits company located in the United States, doing business in the domestic and certain foreign markets. We comply with federal, state, and foreign laws regarding labor practices wherever we operate.

The California Transparency in Supply Chains Act of 2010 (SB 657) (“Act”) seeks the elimination of slavery and human trafficking from product supply chains and requires that large companies who do business in California disclose their efforts toward the elimination of slavery and human trafficking. The information below relates to our efforts to comply with the Act.

1.) The vast majority of our suppliers are located in North America, principally in the United States, and in the European Union. To the best of our knowledge and belief, no supplier to our company, whether located within or without the United States, has ever been accused of engaging in forced labor or human trafficking.

2.) We reserve the right to audit our suppliers operations to ensure compliance with the Act. Currently, audits are not regularly performed by the company or an independent third party.

3.) Our purchase orders and supplier contracts will now contain an express representation that each supplier will comply fully with all applicable laws prohibiting human trafficking and slavery and that any violation of such laws are cause for immediate termination of our contracts and orders. We will terminate our contract with any supplier found to be in violation with our policy on human trafficking and slavery.

4.) To further our efforts to eradicate human trafficking and slavery from our supply chain, we have now asked suppliers to return a signed statement to us acknowledging that they support the elimination of forced labor and human trafficking.

5.) Our Employee Code of Conduct requires that company personnel try to ensure we work only with reputable suppliers. Employees annually affirm their compliance with our Employee Code of Conduct, but we have no formal training related to the issue.

Our Commitment
The United Kingdom Modern Slavery Act 2015 and the California Transparency in Supply Chains Act of 2010 require companies to disclose their efforts to mitigate the risk of modern slavery and human trafficking in their supply chain. Modern slavery and human trafficking are the use of forced, compulsory or trafficked labor or anyone held in slavery or servitude. As a responsible corporate citizen, McCormick Distilling Co., Inc. is committed to actions that will mitigate the risk of modern slavery in our business. In addition, we expect our vendors, suppliers, and contractors to have the same commitment.

Our Controls
McCormick Distilling Co., Inc. is committed to implementing and enforcing controls to prevent modern slavery in our business and in our supply chain. We have regular contact with our vendors, suppliers and contractors. Our contracts with vendors, suppliers and contractors require compliance with all applicable laws. If necessary, we will engage with third parties to assist us in evaluating our supply chain. Any concerns relating to noncompliance with this statement are investigated promptly and appropriate actions will be taken based on the findings of the investigation.

Our Training
We support our commitment and controls by providing training to our employees. The training is designed to create awareness around the problem of modern slavery and to help employees identify the sign of modern slavery in our supply chain.
